All content on this site — photographs, text, graphics and logo — is the exclusive property of Santiago Montenegro (“Santi Montesquieu”) unless otherwise stated, and is protected by French and international copyright law. Any reproduction, representation, modification or distribution, in whole or in part, without prior written consent is strictly prohibited.

Bookings & payments

Bookings are arranged on WhatsApp: we confirm your date together, then you secure it with a deposit (50% for sessions, 30% for weddings — see Weddings below). Deposits and balance payments are processed securely by Stripe. Your card details are never stored on our servers.

I only share photos of you on my website, social media or other promotional material if you say yes. I ask when you book: you can answer yes, no, or yes but without your faces. Your answer never changes the price or the service.

Changing your mind. You can withdraw your consent at any time by sending me a message. I remove the photos from my website and social media within 7 days; printed material already distributed cannot be recalled.

Surprise proposals. The person being proposed to has not booked anything, so I ask them too before sharing any photo.

Children. Photos of children are only shared with the consent of their parents or legal guardians, and children are never named or tagged.

Commercial clients. Use of the images in my portfolio is agreed in the quote.

Your photos are personal data, handled under the GDPR. To access or delete them, write to contact@santimontesquieu.com; you can also contact the CNIL (cnil.fr).

Sessions, editing & delivery

Image selection and editing. The selection of images is part of the photographer's creative work. After the session, I review the full shoot and select the strongest images from each sequence. The number of delivered images stated in each package is a minimum.

RAW files. RAW files and unedited images are not delivered, shown or sold. Only the final edited selection is delivered through the online gallery.

Editing style. Images are edited in the style shown in my portfolio. By booking, the client confirms they have seen and accept this style. Requests for a different editing style or re-editing are not included.

Session conditions. Final results depend on light, weather and time of day. When the client chooses the time or location, or directs the session themselves, the photographer cannot be held responsible for resulting light conditions or missing specific shots.

Rain & weather. Rain or bad weather: we move your session at no extra cost to the next available slot we both agree on.

Rescheduling. One free reschedule is included with more than 72 hours’ notice. Rescheduling because of rain or bad weather is free, to the next available slot we both agree on.

Cancellation & deposit (sessions). A 50% deposit secures your date. The balance is paid on the day. If you cancel more than 7 days before, your deposit is refunded in full. Between 7 days and 72 hours before, your deposit becomes a credit valid for 12 months. Less than 72 hours before, the deposit is non-refundable. See prices →

Weddings. A 30% deposit secures your wedding date; the balance is due 7 days before the day. Because the date is reserved for you alone, the deposit is non-refundable if you cancel. You can move your wedding to a new date once, at no cost, within 12 months, subject to availability.

Late arrival & no-show. You have 15 minutes’ grace. After that, the delay is taken from your session time. If you have not arrived after 30 minutes, this counts as a no-show and the deposit is lost.

If I can't make it. If I have to cancel, you can choose a new date or a 100% refund.

Your photos. I publish photos from your session in my portfolio, on this website and on Instagram only if you agree. You can say so with an optional box when you book, or by replying YES to my confirmation message; not agreeing does not affect your booking. You can withdraw your agreement at any time by WhatsApp or email and I will remove the photos within 7 days. For photos of children, pregnancy or intimate moments, and for the other person in a surprise proposal, I always ask for a specific OK first.

Liability

We make every effort to keep the information on this site accurate and up to date, but cannot guarantee it is free of errors or omissions. The site may contain links to third-party websites over which we have no control and for which we accept no responsibility.

Governing law

This legal notice is governed by French law. Any dispute relating to the use of this site falls under the jurisdiction of the competent French courts.
